SW Notary Services – Mobile Notary Service Policies

1. Business Overview

SW Notary Services provides professional mobile notary services throughout Lake County, Montana and surrounding areas. We operate in full compliance with the Montana Code Annotated, Title 1, Chapter 5, and all applicable rules set forth by the Montana Secretary of State. Our services are delivered at your location — whether at home, office, hospital, or other agreed-upon venue.

2. Scope of Services

We are authorized to perform the following notarial acts under Montana law:

  • Acknowledgments

  • Jurats (oaths and affirmations)

  • Copy certifications (where permitted)

  • Witnessing signatures

We do not:

  • Provide legal advice or interpret legal documents

  • Draft or alter documents

  • Guarantee the legal effect of any notarized document

3. Appointments & Scheduling

  • Appointments may be booked via phone, email, or our online booking form.

  • Same-day service is available when scheduling permits.

  • Cancellations made less than 2 hours before the appointment may incur a cancellation fee.

  • If the signer is not present or prepared at the scheduled time, a no-show fee may apply.

4. Identification Requirements

Montana law requires satisfactory evidence of identity. Acceptable forms of ID include:

  • Current government-issued photo ID (driver’s license, state ID, passport, military ID)

  • Other forms permitted by Montana statute

  • Credible witnesses, when allowed by law, if the signer lacks acceptable ID

If satisfactory ID cannot be provided, we must refuse service.

5. Fees & Payment

  • Notarial Acts: Up to $10 per act, as permitted by Montana law.

  • Travel Fees: Based on mileage or a flat rate, disclosed before booking.

  • After-Hours/Weekend Rates: May apply for services outside standard business hours.

  • Payment is due before service will be performed. We accept cash, approved electronic payments.

6. Travel & Service Area

We serve clients within 15 miles of Polson, Montana. Additional travel fees apply for locations beyond this radius.

Service may be rescheduled in the event of hazardous weather or unsafe travel conditions.

7. Refusal of Service

We reserve the right to decline service if:

  • The signer lacks proper ID

  • The document is incomplete or contains blank spaces

  • There is evidence of coercion, fraud, or incapacity

  • The environment is unsafe or inappropriate for conducting business

8. Recordkeeping

Montana law requires notaries to maintain a bound, permanent journal of all notarial acts.

  • Entries include date, type of act, signer’s name, type of ID, and signature.

  • Journals are stored securely and retained as required by law.

  • All client information is kept confidential except as required by law.

9. Limitation of Liability

Our liability for any claim is limited to the total fees paid for the specific notarial service in question. We are not responsible for the legal content, accuracy, or effect of any document, nor for issues arising from false or incomplete information provided by the client.

10. Code of Conduct

We conduct all services with professionalism, punctuality, and impartiality. We will not notarize documents in which we have a personal or financial interest.

11. Emergency & Safety Policy

We may reschedule or refuse service if conditions are unsafe or if an emergency arises. Clients will be notified promptly of any delays or changes.

12. Client Acknowledgment

By booking or receiving services from SW Notary Services, you acknowledge that you have read, understood, and agree to these policies.
